A Cape Coral man was charged with animal cruelty Monday night after police say he shot and killed his dog.

Korey James Potts, of 813 N.E. 44th Lane, was charged with the aggravated animal cruelty, discharging a firearm in a public of residential property and using a firearm while under the influence of an alcoholic beverage after officers responding to a shots fired-call found a dead dog in the lot next door.

The call came in around 10:45 p.m.

"While en route to the call, the officers were told there was a male screaming a woman's name," the Cape Coral Police Department said in a statement release Tuesday. "After a perimeter was set around the house, they found a large, light brown mixed breed dog that appeared to be deceased lying in the vacant lot next to the house where the shots came from."

"While Korey James Potts exited the residence, he was crying and said that he shot his dog, Gordo," the release states. "Officers could smell the odor of an alcoholic beverage coming from his breath."

Potts admitted to drinking earlier, police said, adding Potts' roommate saw him in the yard with a handgun, a Taurus PT 809 9mm.

"She took the gun and threw it into the vacant lot and brought Potts inside the house," the release states. "Witnesses also reported seeing Potts' dog running around the house outside before hearing gunshots and seeing Potts lying near the dog in the vacant lot."
